For purposes of this Agreement, the following definitions apply:
To use PGH Resell's services, you must:
By creating an account, you represent and warrant that you meet all eligibility requirements. PGH Resell reserves the right to suspend or terminate any account that does not satisfy these requirements.
PGH Resell operates as a consignment agent. Title to all Items remains with the Seller until the Item is sold to a third-party buyer. PGH Resell does not purchase Items from Sellers and assumes no ownership interest in any Item at any time.
Submission of an Item does not guarantee acceptance. PGH Resell reserves the right, at its sole discretion, to refuse or return any Item for any reason, including but not limited to:
If PGH Resell refuses a previously accepted Item, the Seller will be notified and may retrieve the Item at their own expense and arrangement. Items not retrieved within fourteen (14) days of refusal notification may be disposed of at PGH Resell's discretion.
Sellers may deliver Items via the following methods:
PGH Resell will acknowledge receipt of Items within two (2) business days of physical possession. Until such acknowledgment is provided, Items remain entirely at the Seller's risk. PGH Resell shall not be liable for Items lost, damaged, or misdirected during Seller-arranged delivery.
By submitting an Item and creating an account, Seller agrees to the following flat commission structure, effective April 5, 2026:

The commission is a flat fifty percent (50%) of the final Sale Price for all Items selling at or above $5.00. No tiers, no adjustments — the Seller's share is always 50% of whatever the Item sells for. All commission calculations are final.
PGH Resell absorbs one hundred percent (100%) of all eBay seller fees, including percentage-based transaction fees and per-order flat fees. These costs are deducted entirely from PGH Resell's share and are never passed on to the Seller. The 50% the Seller receives is the Seller's full net payout with no further platform-fee deductions of any kind.
PGH Resell covers one hundred percent (100%) of all outbound shipping costs to buyers. Shipping costs are absorbed entirely by PGH Resell and are never deducted from the Seller's proceeds. Sellers are responsible only for costs associated with delivering Items to PGH Resell (inbound shipping), unless otherwise agreed in writing. PGH Resell does not reimburse Sellers for inbound shipping costs under any circumstances.
PGH Resell retains sole and exclusive authority to set, adjust, and modify the listing price of any Item at any time and for any reason, including but not limited to market conditions, platform-specific pricing requirements, buyer demand, and competitive analysis. Seller acknowledges that PGH Resell's judgment regarding pricing is final. PGH Resell will make reasonable efforts to maximize the Sale Price; however, no specific sale price or minimum sale price is guaranteed.
Seller Proceeds are credited to the Seller's account within two (2) business days of confirmed receipt of payment from the buyer. Sellers may request a payout at any time through the Seller Portal via ACH bank transfer or PayPal/Venmo. PGH Resell will process payout requests within two (2) business days of submission.
Each Item accepted by PGH Resell will be actively listed for sale for a maximum period of ninety (90) calendar days from the date the Item is first listed on a selling platform ("Listing Period"). PGH Resell makes no guarantee that an Item will sell within the Listing Period.
Upon expiration of the Listing Period without a completed sale, PGH Resell will notify the Seller via the email address on file and provide the following options:
If PGH Resell does not receive a response from the Seller within fourteen (14) calendar days following end-of-listing-period notification, the Seller shall be deemed to have authorized disposal of the Item. PGH Resell shall have no further obligation to the Seller with respect to such Item and shall not be liable for any value, actual or perceived, associated with the disposed Item. "Disposal" may include, without limitation, donation to a charitable organization, recycling, resale at PGH Resell's own discretion, or discarding.
Sellers retrieving unsold Items are responsible for all associated pickup or return-shipping costs. Items must be retrieved from 5877 Commerce St, Pittsburgh, PA 15206 by appointment, or the Seller may arrange prepaid return shipping at their own expense. PGH Resell is not responsible for arranging or subsidizing retrieval logistics.
In the event a buyer initiates a return, dispute, or claim through eBay or any other platform after an Item has sold, the associated cost — including any refunded amount, platform penalty, or shipping return cost — shall be deducted from the Seller's account balance.
Where an Item is returned in the same or substantially similar condition as when it was originally listed, PGH Resell will make reasonable efforts to relist the Item within the remaining portion of the Listing Period, or for a new 90-day Listing Period at PGH Resell's discretion. Relisting is not guaranteed.
Seller warrants that all Items submitted are accurately described, are in the condition represented, and are free of any defects not disclosed to PGH Resell at the time of submission. If a return or dispute arises as a direct result of Seller misrepresentation, the full cost of the return shall be borne by the Seller, including any platform penalties assessed against PGH Resell.
In the event a buyer initiates a payment chargeback with their financial institution that is upheld by the issuing bank or platform, the corresponding amount shall be deducted from the Seller's account. If the Seller's account balance is insufficient to cover such deduction, PGH Resell reserves the right to seek recovery of the deficit amount directly from the Seller.
PGH Resell agrees to exercise reasonable care in the handling, storage, photography, packaging, and shipment of all Items while they are in PGH Resell's physical possession.
PGH Resell shall be liable to the Seller for damage to an Item only where such damage is directly caused by PGH Resell and is established by one of the following means: express acknowledgment by PGH Resell of responsibility for the damage; or a written determination by the shipping carrier that damage occurred as a result of insufficient or inadequate packaging by the shipper (i.e., PGH Resell). In the event PGH Resell is found liable under this Section, PGH Resell's maximum liability shall be limited to the lesser of: (a) the agreed-upon or estimated listing value of the Item at the time of submission, or (b) the most recent listed sale price.
Where a carrier determines that damage resulted from causes other than insufficient packaging (e.g., carrier mishandling, force majeure, or transit conditions outside PGH Resell's control), PGH Resell shall bear no liability. PGH Resell will cooperate reasonably with any insurance claim filed by the Seller against the carrier.
PGH Resell shall take commercially reasonable precautions to safeguard Items against loss or theft. In the event of documented loss or theft of an Item while in PGH Resell's physical possession, PGH Resell's liability shall be limited to the estimated listing value of the Item as assessed at the time of submission.
PGH Resell assumes no responsibility for Items lost, damaged, delayed, or destroyed during inbound transit to PGH Resell. Sellers are encouraged to use insured and tracked shipping methods when sending Items. Risk of loss during inbound shipping remains with the Seller until PGH Resell confirms receipt.
By submitting any Item and by maintaining an account with PGH Resell, Seller represents, warrants, and covenants to PGH Resell on a continuing basis that:
Seller agrees to indemnify, defend, and hold harmless PGH Resell, its owners, employees, agents, and representatives from any and all claims, damages, losses, penalties, or expenses (including reasonable legal fees) arising from any breach of the representations and warranties in this Section.
All photographs, written descriptions, titles, and other listing content created by PGH Resell in connection with an Item ("Listing Content") are the sole intellectual property of PGH Resell. Seller has no right to use, reproduce, or distribute Listing Content without PGH Resell's express written consent.
By submitting an Item, Seller grants PGH Resell a perpetual, royalty-free, non-exclusive, worldwide license to use photographs of the Item, Item descriptions, sale information, and any other associated content for marketing, promotional, and advertising purposes across any medium. This license survives the completion or termination of the consignment relationship.
If Seller provides photographs or descriptive materials for an Item, Seller warrants that such materials are original, do not infringe any third-party intellectual property rights, and grants PGH Resell the right to use them as described in Section 9.2.
Seller may close their account at any time by contacting PGH Resell. Account closure does not affect obligations arising from active listings, pending sales, open disputes, or outstanding account balances.
PGH Resell reserves the right to suspend or terminate any Seller account at any time, with or without notice, for reasons including but not limited to breach of this Agreement, submission of fraudulent or counterfeit Items, abusive conduct, or any activity that poses a legal, reputational, or financial risk to the business.
To the maximum extent permitted by applicable law, PGH Resell provides its services "as is" and "as available" without warranties of any kind, express or implied. PGH Resell does not guarantee that any item will sell, that any particular sale price will be achieved, or that the Seller Portal will be available without interruption or error.
In no event shall PGH Resell's total liability to any Seller exceed the total Seller proceeds paid to that Seller during the twelve (12) months preceding the event giving rise to the claim, or two hundred fifty dollars ($250.00), whichever is greater. PGH Resell shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Seller agrees to indemnify, defend, and hold harmless PGH Resell and its owners, employees, agents, contractors, and representatives from and against any and all third-party claims, actions, proceedings, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to Seller's breach of any representation, warranty, or obligation under this Agreement; any claim that an Item submitted by Seller infringes a third party's intellectual property rights; any claim that an Item is stolen, counterfeit, or fraudulently obtained; any negligent or wrongful act or omission by Seller; or Seller's violation of any applicable law or regulation.
In the event of any dispute, the parties agree to first attempt resolution through good-faith informal negotiation. Seller should contact PGH Resell at elliot@pghresell.com. PGH Resell will respond within five (5) business days.
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.
Any legal action or proceeding arising under this Agreement shall be brought exclusively in the state or federal courts located in Allegheny County, Pennsylvania. Both parties hereby consent to the personal jurisdiction and venue of such courts.
To the extent permitted by law, both parties waive any right to a trial by jury in any action arising out of or related to this Agreement.
PGH Resell collects and stores personal information provided by Sellers, including name, email address, phone number, and payment information, for the purpose of operating the consignment service. This information is not sold to third parties. By creating an account, Seller consents to PGH Resell's collection and use of personal data as described in PGH Resell's Privacy Policy, which is incorporated by reference into this Agreement.
PGH Resell reserves the right to modify this Agreement at any time. Sellers will be notified of material changes via email or a notice on the Seller Portal. Continued use of PGH Resell's services following notification of a modification constitutes acceptance of the updated terms. If a Seller does not agree to updated terms, they must cease use of PGH Resell's services and may request retrieval of any Items in PGH Resell's possession.
